General rental terms and conditions

These terms and conditions govern any vehicle rental concluded with Dablal Cars in Essaouira. They are provided to the renter and accepted upon signing the rental contract.

Rental terms and conditions in Essaouira — Article I — Condition of the vehicle & mechanics

The renter acknowledges having received the vehicle in good working order and presentation, with all necessary documents. At the end of the rental, they return it in the same condition, clean, with the fuel consumed remaining at their expense. Repairs due to a mechanical breakdown or normal wear of essential parts, as well as fluid levels (water, oil, gearbox), are at the expense of Dablal Cars and are subject to a detailed paid invoice accompanied by the replaced parts. The renter cannot claim any compensation for delay.

Rental terms and conditions in Essaouira — Article II — Rental & deposit

The rental amount is payable in advance. The deposit is mandatory and may be used in the event of an extension. Any extension must be paid before the expiry of the current rental. The deposit covers in particular: unjustified damage, loss of documents, and any costs at the renter's expense as the case may be, upon presentation of supporting documents by the company.

All fines, penalties, taxes and costs resulting from breaches of the highway code, parking regulations or otherwise, committed during the term of the contract, are at the renter's expense.

Rental terms and conditions in Essaouira — Article IV — Use of the vehicle

The renter undertakes that the vehicle will not be used: 1) for the paid transport of passengers or goods beyond the authorized number or weight; 2) for the transport of contraband goods or flammable materials; 3) to push or tow another vehicle; 4) by a driver other than those designated in the contract; 5) by a person under the influence of alcohol, drugs or narcotics; 6) in competition or rally; 7) outside the conditions set by Dablal Cars. The driver must be at least 21 years old and hold a licence valid for at least one year.

Article V — Insurance

The renter acknowledges having read the general insurance conditions of Dablal Cars and undertakes to comply with them.

Article VI — In the event of an accident

Under penalty of forfeiting the benefit of the insurance, the renter undertakes to protect the interests of Dablal Cars and its insurer, in particular: to collect in writing the names and addresses of the parties and witnesses; not to acknowledge liability; not to abandon the vehicle without ensuring its safekeeping; to provide a detailed report to the company; to immediately notify the police in the event of a third party or injuries; to inform Dablal Cars of the place, date and time; to declare the claim in writing within 5 days (24 hours in the event of theft) with the police or gendarmerie report. In the event of an at-fault accident, an excess is due depending on the vehicle category.

Article VII — General provisions

The renter may not assign, sell, mortgage or pledge the vehicle. Any modification of these conditions is valid only in writing. The contract is governed by the law in force; in the event of a dispute, exclusive jurisdiction is granted to the courts of Dablal Cars' registered office.
